TERMS OF SERVICE
Below you will find the regulations of the GWIAZDA STUDIO online store (www.gwiazdastudio.com), which includes information, among others: about how to place an order and conclude a sales contract, delivery and payment methods available in the store, the procedure for withdrawing from the contract, or the complaint procedure.

§ 1
Definitions
For the purposes of these regulations, the following terms have the following meanings:
Buyer – a natural person, a legal person or a defective legal person,
Consumer – a natural person concluding a sales contract with the Seller that is not directly related to his or her business or professional activity,
Regulations – these regulations
Store – online store operating at www.gwiazdastudio.com,

§ 2
Preliminary provisions
Through the Store, the Seller conducts retail sales while providing services to Buyers electronically. Through the Store, the Buyer can purchase products displayed on the Store's website.
The Regulations define the rules and conditions of using the Store, as well as the rights and obligations of the Seller and Buyers.
To use the Store, in particular to make a purchase in the Store, it is not necessary for the Buyer's computer or other device to meet specific technical conditions. Sufficient are:
Internet access,
standard operating system,
standard web browser,
having an active e-mail address.
The Buyer cannot make a purchase in the Store anonymously or under a pseudonym.
When using the Store, it is prohibited to provide illegal content, in particular by sending such content via the forms available in the Store.
All product prices given on the Store's website are gross prices.
§ 3
Services provided electronically
Through the Store, the Seller provides services to the Buyer electronically.
The basic service provided electronically to the Buyer by the Seller is to enable the Buyer to place an order in the Store. It is possible to place an order without having to create an account in the Store.
If the Buyer decides to create an account in the Store, the Seller also provides the Buyer with an electronic service consisting in creating and maintaining an account in the Store. The account stores the Buyer's data and the history of orders placed by him in the Store. The Buyer logs in to the Account using his/her e-mail address and a password defined by him/her.
Creating an account in the Store is done by completing and sending, using the Store's automatic mechanism, a registration form. Upon sending the registration form, an agreement for maintaining an account in the Store is concluded between the Buyer and the Seller. The contract is concluded for an indefinite period, and the Buyer may terminate the contract with immediate effect at any time by deleting the account.
The services are provided electronically to the Buyer free of charge. However, sales contracts concluded via the Store are subject to a fee
In order to ensure the safety of the Buyer and the transfer of data in connection with the use of the Store, the Seller takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification of personal data by unauthorized persons.
The Seller takes steps to ensure the full proper functioning of the Store. The Buyer should inform the Seller about any irregularities or interruptions in the operation of the Store.
Any complaints related to the operation of the Store may be submitted by the Buyer via e-mail to the e-mail address hello@gwiazdastudio.com. In the complaint, the Buyer should provide the name and surname, correspondence address, as well as the type and date of occurrence of the irregularity related to the operation of the Store. The Seller will consider all complaints within 14 days of receiving the complaint and will inform the Customer about its resolution to the e-mail address of the person submitting the complaint.
§ 4
Order
The buyer can place an order as a registered customer or as a guest.
A registered customer is a Buyer who has an account in the Store. The buyer can create an account when placing an order.
In order to place an order, the Buyer is obliged to take the following steps:
select the product or products that are the subject of the order by clicking the "Add to cart" button,
from the basket view, click the "Proceed to checkout" or "Checkout" button,
log in to your account in the Store, continue as a "guest" or create an account in the store - does not apply to the Buyer who logged in to his account before starting to place an order,
provide the order shipping address and invoice data - if the Buyer has previously added specific data to the account, he or she may select these data without having to complete them again or provide other data,
choose the delivery and payment method for the order,
read the Regulations and accept them - the Buyer accepts the Regulations only if he has read their content and actually accepts its provisions; acceptance of the Regulations is voluntary, but necessary to place an order,
The Buyer must provide true personal data in the order form. The buyer is responsible for providing false personal data. The Seller reserves the right to suspend the execution of the order in a situation where the Buyer has provided false data or when these data raise reasonable doubts for the Seller as to their correctness. In such a case, the Buyer will be informed by phone or e-mail about the Seller's doubts. In such a situation, the Buyer has the right to explain all circumstances related to verifying the accuracy of the provided data. If there is no data allowing the Seller to contact the Buyer, the Seller will provide any explanations after the Buyer contacts the Buyer.
The Buyer declares that all data provided by him in the order form is true, while the Seller is not obliged to verify their truthfulness and correctness, although he has such a right in accordance with section 6 above.
§ 5
Delivery methods and payment methods
The buyer can choose from the following methods of order delivery:
in Poland via InPost courier or InPost parcel lockers - cost depends on the order, approximate delivery time: 2-5 business days from the moment of order fulfillment
The delivery cost is borne by the Buyer, unless the Seller specifies otherwise in the Store.
The entity providing online payment services in the field of fast transfers is Autopay S.A.
If there is a need to refund funds for a transaction made by the customer with a payment card, the seller will make the refund to the bank account assigned to the Ordering Party's payment card.
§ 6
Execution of the contract
If the customer chooses the payment method by transfer or payment card, the order processing time is counted from the date of crediting the Seller's bank account or settlement account.
After the Buyer places the order in accordance with the procedure described in § 4 of the Regulations, an order confirmation will be sent to the Buyer's e-mail address.
Fulfillment of the order involves preparing it for shipment to the Buyer or for personal collection by the Buyer. The order is considered completed when the order is prepared for shipment.
The order processing time is up to 21 business days.
The order processing time is counted from the moment of payment for the order.
After completing the order, the Seller will send confirmation of order completion to the Buyer's e-mail address and will begin shipping the order to the Buyer.
The order is shipped to the Buyer in the manner chosen by the Buyer in accordance with § 4 section 1 of the Regulations.
The delivery time of the order to the Buyer depends on the shipping method chosen by the Buyer and is counted from the date of completion of the order in accordance with § 6 section. 3 of the Regulations.
§ 7
Consumer's withdrawal from the contract
The buyer has the right to withdraw from the contract without giving a reason within 14 days from the date of taking possession of the purchased items. In such a case, please send an email to: hello@gwiazdastudio.com and return the item to the following address: ul. Ogrody Bielawy 3, 05-520 Konstancin-Jeziorna, Anna Eliza Gwiazda Design Studio.
The shipping cost is covered by the Buyer.
The refund for the item will be transferred to the same account from which the payment was made.
GWIAZDA STUDIO is not responsible for improper securing of returned items during courier shipment. If GWIAZDA STUDIO receives damaged items, the Buyer will not be entitled to a refund for the purchases.
If the Buyer receives an item damaged during courier shipment, a complaint must be made. In this case, please send an e-mail to: hello@gwiazdastudio.com with an attached photo of the damaged item. We will try to deliver a new product, or if the purchased product is not available, we will refund your purchase.
All Goods purchased in the Online Store are subject to a 2 (two) year warranty, in accordance with the Consumer Rights Act and the Civil Code Act.
GWIAZDA STUDIO recommends keeping proof of purchase - e.g. receipt, invoice.
In the complaint, the Buyer should provide details of the complaint, in particular what Goods are being complained about, when the defect was noticed, as well as the circumstances justifying the complaint and the Buyer's demands.
GWIAZDA STUDIO will inform the Consumer about its position regarding the validity of the submitted claim within 14 days from the date of filing the complaint by the Consumer.
The shipment with the complained Goods should include a declaration by the Consumer, containing a reasonably detailed description of the defect of the Goods and the Customer's current return address, with a contact telephone number or e-mail address to enable direct and immediate contact with the Consumer.
If, as a result of GWIAZDA STUDIO recognizing the complaint as justified, the Goods were repaired or replaced with a new one, or the reported complaint was rejected as unfounded, GWIAZDA STUDIO will immediately return such Goods by courier to the address provided by the Consumer, unless another form of transfer of the Goods is agreed with the Customer.
If, at the request of the Customer, GWIAZDA STUDIO has reduced the price of the complained Goods or is to refund the funds (price of the Goods), the relevant claim will be fulfilled by GWIAZDA STUDIO, using the same method of payment as used by the Customer, unless the Consumer has expressly agreed to another method of return that does not involve any costs for him.
If the complained Goods are not collected by the Customer, GWIAZDA STUDIO will call the Customer in writing or in another manner personally agreed with the Customer to collect the Goods within 14 days from the date of receipt of such a call. After the ineffective expiry of this additional deadline, GWIAZDA STUDIO will consider the complaint procedure closed.
A complaint submitted by a Buyer who is not a Consumer without an attached document confirming the sale will not be considered.
§ 8
Liability for defects
The Seller is obliged to provide the Buyer with a product free from defects.
The Seller is liable to the Buyer if the product sold has a physical or legal defect (warranty for defects).
If the sold product has a defect, the Buyer may:
demand replacement of the product with a defect-free one,
demand removal of the defect,
submit a declaration of price reduction,
submit a declaration of withdrawal from the contract.
If the Buyer finds a defect in the product, he should inform the Seller about it, specifying his claim related to the identified defect or submitting a declaration of appropriate content.
The Buyer may contact the Seller both by traditional mail and by e-mail.
The Seller will respond to the complaint submitted by the Buyer within 14 days from the date of delivery of the complaint to him via the means of communication through which the complaint was submitted.
Details regarding the Seller's warranty for defects are regulated by the provisions of the Civil Code (Articles 556 - 576).
§ 9
Final Provisions
The Seller reserves the right to introduce and revoke offers, promotions and to change the prices of products in the Store without prejudice to the rights acquired by the Buyer, in particular the terms of contracts concluded before the change was made.
The Seller reserves the right to make changes to the Regulations. The Regulations in force on the date of conclusion of the contract shall apply to contracts concluded before the amendment of the Regulations.
Buyers who have an account in the Store will be notified about any changes to the Regulations by e-mail to the e-mail address assigned to the account. If the content of the new Regulations is not accepted, the Buyer has the right to terminate the account management agreement at any time by deleting the account or submitting to the Seller an appropriate declaration, in any form, terminating the account management agreement.
These Regulations are valid from December 10, 2023.
